ARTICLE 3 – Subject

The subject of this Agreement is to determine the rights and obligations of the parties, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, regarding the sale and delivery of the products ordered electronically by the Buyer through the Seller’s website, the qualities and sales price of which are specified.

By approving this Agreement, the Buyer declares that they have also read and accepted the Terms of Use, Privacy Policy, and Membership Agreement available on the website.

ARTICLE 4 – Basic Characteristics of the Products Subject to Sale and Payment Information

4.1. The type, quantity, sales price, payment method, and delivery information of the products are as stated on the order summary page and have been approved electronically by the Buyer.

4.2. Unless otherwise stated, the shipping fee shall be borne by the Buyer.

ARTICLE 5 – Validity Period of Commitments

The prices offered for sale are valid for the period during which they are announced. Time-limited campaigns automatically expire at the end of the specified period.

ARTICLE 6 – Delivery of Products

6.1. The products shall be delivered to the delivery address specified by the Buyer within no later than 30 (thirty) days from the order date, together with the invoice, properly packaged, and in sound condition.

6.2. If the products are delivered to a third party, the Seller shall not be responsible for any issues arising from the refusal to accept delivery.

6.3. The Buyer is obliged to inspect the product at the time of delivery. In the event that a broken, cracked, or damaged package is identified, a damage report must be issued by the cargo officer and the product must not be accepted. Otherwise, the responsibility shall be deemed to belong to the Buyer.

ARTICLE 7 – Right of Withdrawal

7.1. The Buyer may exercise the right of withdrawal within 14 (fourteen) days from the delivery of the product, without providing any reason.

7.2. In order to exercise the right of withdrawal, written notification must be made to the Seller within this period by e-mail or registered mail with return receipt requested.

7.3. The products to be returned must be in their original packaging, unused, and in a resalable condition.

7.4. Following receipt of the withdrawal notification by the Seller, the payment shall be refunded within no later than 14 days using the same payment method used by the Buyer.

7.5. For returns made within the scope of the right of withdrawal, the shipping fee shall be borne by the Seller.

ARTICLE 8 – Products for Which the Right of Withdrawal Cannot Be Exercised

The right of withdrawal cannot be exercised for the following products:

• Customized ceramic products produced specifically for the Buyer
• Products produced in special sizes, colors, patterns, or upon special order
• Products that have been used, damaged, or are no longer in a resalable condition
• Products that have been broken after delivery or damaged due to user error

ARTICLE 9 – General Provisions

9.1. The Buyer acknowledges that they are aware of the basic characteristics, sales price, and delivery terms of the product.

9.2. The Seller is obliged to deliver the products completely and in accordance with the qualities specified in the order.

9.3. In the event of force majeure or impossibility of supply, the Buyer shall be informed and the payment shall be refunded.

9.4. If the product price is not paid or is cancelled by the bank, the Seller’s delivery obligation shall cease.

ARTICLE 10 – Competent Court

Consumer Arbitration Committees and Consumer Courts shall have jurisdiction over any disputes that may arise from this Agreement.

ARTICLE 11 – Other Provisions

This Agreement shall enter into force on the date it is approved electronically by the Buyer on the website.

The invoice relating to the order, the Membership Agreement, and the Privacy Agreement are integral parts of this Agreement.
